Welcome to GOOBINGOO. By accessing or using goobingoo.com, you agree to be bound by these Terms of Service. If you don't agree with any part of these terms, please don't use the site.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase on goobingoo.com. By using the site, you confirm you meet this requirement.
2. Products and Pricing
- All products are subject to availability. We reserve the right to limit quantities, refuse or cancel orders, and discontinue any product at any time.
- Prices are listed in U.S. dollars unless otherwise noted and are subject to change without notice. The price that applies to your order is the price displayed at the time you place it.
- We make every effort to display product information accurately, but we don't warrant that descriptions, images, or other content are error-free. Minor color, size, and design variations may occur.
3. Orders and Payment
- Submitting an order is an offer to buy. We reserve the right to accept or decline any order at our discretion (e.g., suspected fraud, payment errors, or stock issues).
- Payment is collected at checkout. By providing payment information, you authorize us to charge the applicable amount.
- If we cancel your order, we'll refund any payment received in full.

5. Mobile Messaging Terms (SMS/Text Program)
5.1 Program description. The GOOBINGOO SMS marketing program ("Program") allows users to receive promotional and transactional text messages from GOOBINGOO. By opting in, you consent to receive recurring automated marketing text messages — including but not limited to promotions, order updates, abandoned-cart reminders, new product launches, and other GOOBINGOO-related communications — sent via an automatic telephone dialing system. Consent is not a condition of any purchase.
5.2 How to opt in. You may join the Program by submitting your mobile phone number through the sign-up form on goobingoo.com, at checkout, or by texting a keyword to our short code or toll-free number when offered. By providing your mobile number, you confirm that you are the account holder or have the account holder's permission to enroll the number, and you agree to these Mobile Messaging Terms.
5.3 Message frequency. Message frequency varies. You may receive up to 10 messages per month, though frequency may be higher around promotional events.
5.4 Message and data rates. Message and data rates may apply to each message sent or received in connection with the Program, depending on your mobile carrier and plan. GOOBINGOO is not responsible for any carrier-imposed message or data charges.
5.5 How to opt out. You may opt out of the Program at any time by replying STOP to any text message you receive from us. After replying STOP, you will receive one final confirmation message, after which no further marketing texts will be sent. You may also opt out by emailing support@goobingoo.com with the subject line "SMS UNSUBSCRIBE" and the mobile number you wish to remove.
5.6 How to get help. Reply HELP to any text message from us for support information, or contact us at support@goobingoo.com or (718) 207-8659.
5.7 Supported carriers. The Program is available on all major U.S. mobile carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages.
5.8 Eligibility. You must be at least 18 years old (or the age of majority in your jurisdiction) and a resident of the United States to participate in the Program. By opting in, you represent that you meet these requirements.
5.9 Privacy. Our collection, use, and sharing of mobile phone numbers and SMS-related data is governed by our Privacy Policy. We do not sell or share SMS opt-in data with third parties for marketing purposes.
5.10 Disclaimer of liability. The Program is provided on an "as-is" basis. GOOBINGOO is not responsible for any delays, errors, or non-delivery of messages caused by your wireless carrier, equipment, or other circumstances outside our control. We reserve the right to modify or terminate the Program at any time without notice.
5.11 Changes to these Mobile Terms. We may update these Mobile Messaging Terms from time to time. The most recent version will always be posted on goobingoo.com with its effective date. Your continued participation in the Program after changes are posted constitutes acceptance of the updated terms.

6. Customer Accounts
If you create an account, you're responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at support@goobingoo.com if you suspect unauthorized access.
7. Acceptable Use
You agree not to:
- Use the site for any unlawful purpose
- Attempt to gain unauthorized access to any part of the site, our systems, or other users' accounts
- Use automated tools (bots, scrapers) to access the site without our written permission
- Interfere with or disrupt the site, our servers, or networks
- Submit false, fraudulent, or misleading information
- Infringe on any intellectual property rights
8. Intellectual Property
All content on goobingoo.com — including logos, product images, text, video, and design — is the property of GOOBINGOO or our licensors and is protected by copyright, trademark, and other laws. You may not copy, reproduce, or distribute any content without our written permission.
9. User Submissions
If you submit reviews, comments, or other content to the site, you grant GOOBINGOO a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with our business.
10. Disclaimers
The site and all products are provided "as is" without warranties of any kind, except those that cannot be disclaimed under applicable law. To the fullest extent permitted by law, GOOBINGOO disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, GOOBINGOO'S total liability for any claim arising out of or relating to your use of the site or purchase of products is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
12. Indemnification
You agree to indemnify and hold harmless GOOBINGOO, its owners, and its employees from any claims, damages, or expenses arising out of your use of the site, your violation of these Terms, or your infringement of any third-party rights.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of goobingoo.com will be brought exclusively in the state or federal courts located in New York County or Kings County, New York, and you consent to the jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms at any time. The most recent version will be posted on goobingoo.com with its effective date. Your continued use of the site after changes are posted means you accept the updated Terms.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
